Skimmed the findings of fact released by Baylor. The thing that jumped out to me was the massive administrative burden Title IX places on institutions beyond just equal participation in athletics.
Obviously institutions have a duty to report allegations of criminal activity to the proper authorities and to let the legal system then run its course. Baylor certainly admitted egregious mistakes. On the other hand, the additional obligations mandated by Title IX in recent years have created implementation challenges that even the most well-run institutions would have difficulty managing.
Got a feeling that this report is triggering anxiety attacks at plenty of other schools around the country, especially considering the potential exposure to liability.
